Terms of Instagram Contest “Coffee Day Giveaway from Venetis Bakery” “Athens Coffee Festival Giveaway from Venetis Bakery”
The anonymous company under the trade name “VENETIS ANONYMOUS FOOD INDUSTRIAL AND COMMERCIAL COMPANY” based in Lykovrysi, Attica, Agias Paraskevis 9, ZIP 14123 (hereinafter referred to as the “Organizer”), legally represented, aiming to promote its products, organizes electronically via the Internet the promotional action “Athens Coffee Festival Giveaway from Venetis Bakery”, with a draw of ten (10) double invitations, which will be awarded to a total of ten (10) winners (hereinafter referred to as “the Action” or “the Contest”). By participating in the contest, all participants fully and unreservedly accept the following terms:
Contest Object
1.1 The Contest will take place on the social media platform “Instagram”, specifically through the official account of the Organizer at the following address: https://www.
Right to Participate
2.1 The right to participate in the Contest is granted to all permanent and legal residents of Greece who have reached the age of 13, registered as members on Instagram, declaring a unique username (‘Username’) and password (‘Password’). Their account must be active, compliant with all Instagram terms, and its operation must not be suspended or terminated for any reason.
2.2 In the case where the participant is under 18 years old, participation consent must be provided by a parent or legal guardian. If selected as a winner, collection must be made by the parent or guardian who gave consent for participation.
2.3 Employees, collaborators, or anyone with any professional or other relationship of any kind with/from the Organizer, spouses, persons who have entered into a cohabitation agreement with the above persons, and relatives of such persons up to the second degree are not eligible to participate in the Contest. Anyone else professionally associated in any way with this action is also excluded.
2.4 Any participation by the above individuals in the Contest in violation of these terms is deemed automatically void and will be considered as if never declared or held, and it does not yield any results or bind the Organizer and/or any third party.
Contest Duration
3.1 The Contest will take place from Wednesday, September 20, 2023, at 09:00 am until Friday, September 22, 2023, at 11:59 pm.
3.2 After the end of the Contest, no participation is accepted, otherwise considered as never declared or held, and does not yield any results or bind the Organizer and/or any third party.
3.3 The Organizer reserves the right to postpone or reschedule the time and/or day of the Contest and/or the draw at any time at its absolute discretion, or to cancel the Contest entirely, by providing relevant information on the above official Instagram account of the Organizer or on the Organizer’s website https://
Method of Participation
4.1 Each participant must have a personal Instagram account. In order to participate in the contest, the user must:
(i) follow the account @fournosveneti
(ii) like the relevant post of the Contest, and
(iii) mention one (1) friend.
4.2 It is expressly stated that the Organizing Company reserves the right to deem void or retrospectively remove any participation whose content promotes competitive products of the Organizer or violates the law or good morals in any way, at its absolute discretion. Additionally, entries containing offensive or disrespectful content towards Public, Administrative, Ecclesiastical Authorities, or any third party, content that is abusive, inflammatory, racist, or contrary to legal provisions, or in any other way indecent, will be canceled, according to the absolute judgment of the organizer. Moreover, entries with content presenting ambiguities or other technical defects will not be accepted.
4.3 Participation in the Contest does not require the purchase of a product or any other financial burden on the participant.
Valid Participation
5.1 All valid entries have the right to participate in the prizes. A valid entry is considered one that (a) meets the conditions of all stages of the Contest, as described in these Terms, (b) does not constitute, in the judgment of the Organizer, a product of illegal technical influence by the participant on the systems of the Organizer, or fraud or unfair intervention by the participant or a third party in general, (c) has been submitted from the start date and time of the Contest until the end date and time of the Contest, and (d) does not contradict term 4.2 herein.
5.2 The Organizer reserves the right to reject invalid entries that violate these terms, as well as to cancel even retrospectively entries that do not comply with these terms. In this last case, the Organizer may, regardless of its other claims, demand the return of any gift or other benefit that the participant has already received from participating in the Contest. Exclusion for any of the above reasons is made without adherence to wording or deadlines, and without requiring prior notice to the excluded participant and justification for exclusion/cancellation of participation.
Prizes – Winner Selection – Drawing Procedure
6.1 The prizes that will be awarded to the winners will be ten (10) double tickets, which will be received by a total of ten (10) people. Therefore, each winner will receive one (1) invitation.
6.2 The selection of winners will be made by a random electronic draw through a reliable electronic means and through a certified application that does not allow human intervention, in the presence of the representatives of the Organizer. In case the number drawn belongs to a person who has already been selected as a winner in the same draw, then the next integer number from the one resulting from the electronic draw is selected as the winner.
6.3 The winners will be announced on Friday, September 22, 2023, in a comment on the above post of the Contest. Within twenty-four (24) hours of the announcement at the latest, the Organizer will contact the winners via a message on the Instagram account of each winner to inform them individually of their victory and to obtain all the necessary identity information (including the age of the winner), the email address of the winner to send the invitation details, as well as the information required by tax legislation for the disposal of the gift. If the winner does not confirm the acceptance of the gift until Saturday, September 23, at 12:00 noon, he/she is excluded from receiving the gift, and the specific participation/win/gift is not replaced by another participant in the Contest. The verification of the winner’s information will be carried out by the Organizer, who is entitled to verify, by any appropriate means and at its discretion, the identity of the persons mentioned above who will receive the Gift. Indicatively, it has the right to request the presentation of an Identity Card or other document, at its discretion, proving the identity and age of the person. Proof of compliance with the above conditions is a resolutive condition for the delivery of the Gift to the winners. Each participant acknowledges and accepts that his personal data will be posted in accordance with the above procedure and agrees to the said procedure for conducting the Contest and announcing the winners.
6.5 By accepting the gift, the Participants explicitly and unreservedly declare that they fully accept the validity of the conduct of the procedure and its results and that they cannot raise any claim for the way in which it was conducted. 6.6 No participant is considered or authorized as the final winner, only when the allocation of the Gift to him has been completed, according to these Terms. The publication of the name of the person identified as the winner on the official account of the Organizer does not make the result final, nor does it establish any claim of that person.
Responsibility
7.1 The responsibility of the Organizer is limited to the provision of the scheduled Gifts (in-kind and not monetary compensation) described exclusively through the above-mentioned procedures. The Organizer does not assume, nor will it undertake, any other obligation towards the Participants.
7.2 The Organizer is not responsible for the non-registration or receipt of the Gift by each winner within the specified deadlines.
7.3 The Organizer is not responsible criminally or civilly for any Participant, winner, winner’s companion, or third party for any accident or damage or for any bodily or other harm caused directly or indirectly to them related to the gifts, the use of the gifts, or for any other reason. Also, the Organizer does not assume any responsibility nor guarantees the functionality or absence of defects of the Gift, nor does it guarantee any agreed property.
7.4 After the end of the Competition and the delivery of the Gifts as mentioned above, all obligations of the Organizer will remain.
7.5 Note that this contest is not funded or conducted by Instagram, nor is it in any way related to it.
Technical Means
8.1 Participation in this Contest requires participants to have access to the Internet through their own technical means. The Organizer assumes no obligation regarding ensuring access to Internet spaces or providing facilities to any interested party. Access to the Contest website is allowed only under the terms of operation of the respective server and the technical and other conditions and specifications of the Contest. Furthermore, the Organizer is not responsible for any financial or other burden on participants-users for the above reasons.
8.2 Participants explicitly agree that they have accepted the registration terms of Instagram, as well as its general terms of use and policies, and consequently waive any relevant claims against the Organizer.
8.3 Furthermore, the Organizer is not responsible for any damage that may occur to its account resulting in the temporary or permanent interruption of the Contest or the cancellation of certain entries due to non-registration of their posts, as well as technical difficulties that may arise due to Internet network issues (such as, but not limited to, force majeure, technical problems, network coverage, network overload, disconnection from the network, improper participation).
8.4 The Organizer does not guarantee that the Contest website or the servers through which it is made available to participants will be provided without “viruses” or other harmful components or that the websites, services, options, or results are correct, complete, and available at all times. Each participant has the exclusive responsibility to ensure, through the use of antivirus software, the non-infringement and protection of their personal computer and files from viruses or destructive programs – applications, as well as the possible combating of any detected virus. Trademarks – Intellectual Property
9.1 Participants do not have, nor do they acquire, any absolutely right over the trademarks, trade names, names, emblems, and other distinctive features or any other right of the Organizer or another company. Any modification, publication, transmission, transfer, reproduction, distribution, presentation, connection, loading (“download”), or other exploitation, in whole or in part, of the content of the Contest is prohibited without the prior written permission of the Organizer.
9.2 Furthermore, the Organizer is not responsible for the content of the participants’ posts on the Contest, where participants are prohibited from posting or disclosing in any way through the Organizer’s website any work of a third party or personal data of third parties without their prior consent.
9.3 Each participant grants the exclusive right to exploit their comment (including any intellectual property rights, image rights, etc.) to the Organizer free of charge indefinitely, which has the right to use, display, and exploit it at its absolute discretion in any way and on the internet. Participants confirm that they own the full rights to the comment they post on the page, which they automatically assign to the Organizer with their participation and consent to its use by the Organizer for the needs of this action and the promotion of the Organizer. The Organizer is not responsible for the comments posted by each user. Participants unreservedly accept that with any comments they may post, they will not violate any right of either the Organizer or a third party.
9.4 During the promotional action, any comments or posts that are defamatory, obscene, violate intellectual property rights or other rights of third parties, or contain any illegal content, at the absolute discretion of the Organizer, will be immediately deleted from the Organizer’s website, and the Participant who posted such comments will be excluded from the Contest. Participants are required to act legally and within the framework of these terms and conditions and user and transaction ethics.
Personal Data
10.1 Participation in the Contest requires and makes it necessary to collect and process the personal data of the participants, which are described below and are kept and processed by the Organizer in accordance with Regulation 2016/679 (GDPR) and the provisions of Law 4624/2019, exclusively for (a) the purposes of the Contest (participation, announcement/publication of results) and the award of Prizes (based on Article 6 para. 1.b of the GDPR), (b) the promotion and advertising of the Contest for promotional purposes (based on Article 6 para. 1.f of the GDPR), (c) fulfilling any obligations of the Organizer provided by the current legislation (e.g. tax legislation) (based on Article 6 para. 1.c of the GDPR), and (d) satisfying its legitimate interests, such as the legal prescription of claims related to the Contest (based on Article 6 para. 1.f of the GDPR), always in accordance with the applicable legal framework.
10.2 Specifically, the personal data collected and processed are:
A) For participants: Instagram ID, Instagram account details, the participant’s full name and the full names of both (2) friends, comment content for the purposes of participating in the Contest.
B) For winners: In addition to the above, a copy of identification for age verification, contact phone, and home address for prize collection by each winner.
10.3 The above data will be retained by the Organizer for the period and to the extent that is absolutely necessary for the fulfillment of the above purposes, always in accordance with the applicable legislation. For example, the winner’s contact details will be kept until the legal age is verified, the prize is delivered, and the obligations of the Organizer arising from tax legislation, etc. and the legal prescription of claims by third parties related to the Contest.
10.4 The above personal data will be disclosed only where necessary for the implementation of the above-mentioned processing purposes (e.g., tax and administrative authorities).
10.5 If at any time a participant wishes to no longer have their personal data processed, they can withdraw their participation without any charge during business days and hours from 10:00 am to 5:00 pm by email at info@venetis.com.grAny withdrawal of participation will not affect the legality of data processing until the withdrawal is notified to the Organizer. Furthermore, anyone interested can exercise the rights arising from Articles 12 et seq. up to 22 of the General Data Protection Regulation (EU) 2016/679 (right to information, access, correction, deletion, processing limitation, objection, and portability) by contacting the same above contact details. If anyone wishes to exercise the right to lodge a complaint with the Data Protection Authority, they can address it to the following address: complaints@dpa.gr. Detailed terms for the processing of personal data are provided on the Organizer’s website (http://www.fournosveneti.gr).
Other Terms
11.1 Participation in the Contest requires unconditional acceptance of these Participation Terms and involves waiving any related claim of any kind against the Organizer.
11.2. 11.2 The Organizer reserves the right to modify, revoke, extend, or reduce the duration of these Contest Terms, at its discretion, as well as to change the terms and dates of participation and/or to cancel the promotional activity and consequently the provision of the Prizes with a relevant announcement on the official Instagram account or the Organizer’s website. Any such modification will be an integral part of the Terms and will apply from their posting.
11.3 In any of the above cases, the Organizer bears no liability towards the participants. In the event of revocation, cancellation, interruption, extension, postponement, etc., of the Contest, participants do not acquire any rights against the Organizer, nor are they entitled to request the completion or continuation of the Contest or any compensation.
11.4 If any of these Terms is deemed illegal, void, or unenforceable, the validity and enforceability of the remaining terms are not affected.
11.5 Failure by the Organizer to exercise any of its rights once or repeatedly is not considered a waiver of that right.
11.6 Any participant or third party is entitled to receive, at their own expense, an exact copy of these Terms.
11.7 These Terms and the Contest are governed by Greek substantive and procedural law. Any dispute related to the Contest and the application of these detailed terms, which may arise in the future, falls within the exclusive jurisdiction of the Athens Peace Court and/or the Athens First Instance Court, depending on the amount and nature of the dispute. In the case of the operation of more First Instance Courts within the Athens Metropolitan Area, the one based in the Municipality of Athens is designated as competent.
